Assistance for all claims from the Compensation Fund

EMPLOYER CLAIMS

Where an employer paid an employee whilst the employee was off duty due to his IOD, such salary advances can be claimed back from the fund.


• Employers can recover the salary advances they paid when an employee was booked off for longer than three days.

• Whether you paid 75% or 100%, you are entitled to claim back all the months that you paid your employee whilst he/she was off duty.

• Where Employers paid medical expenses related to the IOD, the employer can claim back such monies.

• Certain requirements need to be met, but an employer can claim a rebate on your Return Of Earnings.


EMPLOYEE CLAIMS EXAMPLES

Employees that meet with a Temporary Total disablement OR Permanent Disability are entitled to compensation.

The amounts payable in terms of compensation is determined by you wages and the percentage disability.

Employees with a disability of less than 30% will receive a lump sum.

Where employees with a disability of more than 30% will receive a monthly pension.

The degrees of disability are set out in Schedule 2 of the Compensation for Occupational Injuries and Diseases Act and can be found on our website.


Some examples of calculation.


Example 1:

Ricardo has lost his sight in both eyes after chemicals that he works with accidentally splashed into his eyes. At the time of his accident he was earning R4 000 per month.

The percentage disability for total loss of sight is 100%.

Multiply monthly salary by 75: 75 * 4 000 = 300 000

Divide by 100: 300 000 ÷ 100 = 3 000

Multiply by 100 (percentage disability): 3 000 * 100 = 300 000

Divide by 100: 300 000 ÷ 100 = R3 000 per month


Example 2:

Jono lost a big toe while working with a grinder. Before the accident happened, he earned R2 000 a month. What compensation should Jono get for his permanent disability?

The percentage disability for the loss of one toe is 7%. Jono will get a lump sum because his injury was 30% or less. To calculate the lump sum:

Multiply monthly wage by 15: R2 000 * 15 = 30 000

Multiply by 7 (percentage disability): 30 000 * 7 = 210 000

Divide by 100: 210 000 ÷ 100 = R2 100 lump sum


Example 3: 


How to gross up a weekly wage to a monthly wage:

Raynique’s wages are R300 per week.

What would her Compensation be for a temporary total disability?

Multiply weekly wage by 4: R300 * 4 = 1 200

Divide weekly wage by 3: R300 ÷ 3 = 100

Add to get monthly wage: 1 200 + 100 = R1 300

Multiply monthly wage by 75: 75 * R1 300 = 97 500

Divide by 100: 97 500 ÷ 100 = R975 per month

 

Medical Service Provider Claims

All reasonable medical expenses are covered by the Compensation Fund/RMA/FEM.

Medical service providers should be registered before they can claim from the applicable fund.

SERVICES

  • Company Registration
    • To register a company where the company has not been registered, or to register new companies as per S 80 of COIDA.
  • Banking Details
    • In order to receive any refunds or to retrieve any salary advances from the Compensation Fund, a company needs their banking details verified and loaded on their electronic system.
    • We will verify whether the clients banking details are registered.
    • All relevant documents will be completed and submitted on behalf of the company.
  • Return of Earnings (ROE)
    • Ensure correct and timeous submission of the ROE.
    • Ensure the assessment is correct.
    • Ensure timeous payment on your assessment.
    • Arrange for a payment plan where need be.
    • Address incorrect penalties and/or interest.
  • Letter of Good Standing (LOGS)
    • After compliance by paying your assessment, we will obtain your LOGS for you.
    • Ensure correct classifications, name of business and further details.
  • Verifications of Letter Of Good Standings

    • Companies are encouraged not to deal with subcontractors of broker

    where their LOGS is not in place and/or fabrications.

    • We Will verify LOGS’s on your behalf and ensure compliance from

    those companies.

  • Audits or Investigations on Return Of Earnings

    • Where mistakes have been made when submitting your ROE, we can

    assist in resolving the audit or dispute on a matter.

    • We deal directly with the fund in

  • Standard Operating Procedure (SOP)

    • COID Consult to draft an SOP specifically for the clients’ needs when

    an accident or disease occurs.

    • The SOP cover advice on which medical service providers to use, what

    protocol to follow with serious and non-serious injuries.

    • Ensure the correct documentation is submitted and when to submit it.

  • Complete running of you Injury On Duty cases - Including everything to do with Umehluko

    • COID Consult will take procedural control of any IOD or Disease that

    occurs.

    • Submission of your Employers Report Form (W.Cl 2) onto Umehluko

    and providing you with a claim number within 48hours after receipt.

    • We ensure that liability gets accepted for the IOD/Disease.

    • We submit the First Medical Reports to the Compensation Fund.

    • We take care of Progress Reports and Final Medical reports on your

    behalf.

    • We will take care of the whole process from date of accident to

    finalization of the claim.

    • The above enables us to recover payments made by you to the

    employee whilst he/she was off duty.

  • Temporary Total Disablement (TTD)

    • COID Consult will submit the necessary paperwork to the

    Compensation Fund in order to claim back salaries that you paid to

    injured workers whilst they were off duty.

    • COID Consult will also recover medical expenses the company might

    have paid on an injured employees’ behalf.

    • Monies get paid into the client’s bank account,

    • COID Consult agrees to a 15% commission of all capital recovered for

    the client. The 15% is over and above the retainer fee.

    • TTD payments are billed monthly when a remittance was received by

    the Compensation Fund.

  • Employee assistance

    • COID Consult will offer assistance to the companies’ employees that

    are injured on duty.

    • The Client simply refers the employee to us, removing that headache

    for the employer.

    • COID Consult enters into its own agreement should the employee wish

    to, to assist in recovering his/her compensation.

  • Historic Claims

    • COID Consult can “look into” all your old IOD claims where you have

    not claimed back your “TTD monies”.

    • A due diligence will be performed on all you IOD claims dating back to

    1 August 2014.

    • We will do an assessment to see what is needed to recover monies on

    your behalf.

    • COID Consult will submit the necessary documentation and claim back

    old historic monies owed to you by the Compensation Fund.
